Canada & National Treatment
Back in 2020’s 3rd quarter newsletter, we informed you that US performers and record labels (as of 1st of July 2020) qualify for “National Treatment”.
Here is a recap: US performers and labels are now eligible to collect neighbouring rights from the public performance of their recordings in Canada.
In order to grant full National Treatment to US sound recordings, previous restrictions on eligibility have been lifted. Consequently, US recordings are eligible for all uses including commercial radio and public performance.
Performances on recordings which are recorded in the USA and owned by a US entity (person or company), will now be eligible to receive royalties. ACTRA RACs (the Canadian neighbouring rights society) is closing out their 2001-2013 usage period, so the sooner the better in getting your claims in!
